We are dedicated to furthering the art of CAKE, CANDY and COOKIE DECORATING. For this reason we have elected to offer our products on the web. We also have a 15,000 square foot retail store open to the public at 3665 Dixie Hwy, Hamilton, OH 45015. We carry over 30,000 products from some 300 different manufactures, distributors, vendors, and importers. You are welcome to shop on our WEB STORE and/or in our RETAIL SHOP. Welcome to Sugarcraft. These terms and conditions govern your access to and use of this website and various online tools and services that Sugarcraft makes available to customers and all others users of the Sugarcraft service, collectively called Users of the Sugarcraft service (the Service).

I have read and agreed to be bound by the Refund Policy and Terms of Service Agreement as set forth by Sugarcraft, Inc. and sugarcraft.com.

2. ***INTERNATIONAL CUSTOMERS***
I have read and agreed to be bound by the Refund Policy and Terms of Service Agreement as set forth by Sugarcraft, Inc. and sugarcraft.com. I do agree to pay the correct shipping cost by choosing "INTERNATIONAL EXPRESS" at checkout (pull-down menu). Shipping costs more for other countries and I agree to pay it. If for any reason, my credit card is not in the USA Visanet system (used to clear credit card payments), that I will abide by terms in securely emailing proicer@sugarcraft.com proof of ownership of credit card right after sending my order. *You can check your APPROVED copy for this: "Card authorized, Address verification results unknown" and will then verify as outlined for International ordering. Click "REQUIREMENTS" for clearing International credit cards. (Or any other credit card that brings up an error message because of a wrong BILLING address.)

3. ***CANADADIAN CUSTOMERS***
I live in Canada so I will choose CANADA as my shipping option. Shipping costs more for other countries and I agree to pay that cost shown on my order. Brokerage Fees: It may be necessary for you to pay additional duty, taxes and brokerage fees once your package arrives, according to Canadian Law. If you are not home to recieve your package, it will be disposed of. No refund will be issued by Sugarcraft, Inc. or the shipper. More.

TOS: By accessing and using the Sugarcraft®! Services, you accept and agree to be bound by the terms and provision of the TOS. The following agreement (this "Agreement" or the "Terms of Service") describes the terms on which Sugarcraft® (http://www.sugarcraft.com) offers you access to its services. This offer is conditioned on your agreement to all of the terms and conditions contained in the Terms of Service (as described in depth below), including your compliance with the policies and terms linked to (by way of the provided URLs) from this Agreement. By using Sugarcraft®, you agree to these Terms of Service. If you do not so agree, you should decline this agreement, in which case you are prohibited from accessing or using Sugarcraft®. Sugarcraft® may amend this Agreement at any time in its sole discretion, effective upon posting the amended Agreement at the domain or subdomains of http://www.sugarcraft.com where the prior version of this Agreement was posted, or by communicating these changes through any written contact method we have established with you.

DETAILS OF RESPONSIBILITIES

(a) Your Responsibilities. In accordance with terms and conditions contained herein, by accessing the website, you agree to (i) be bound by the terms and conditions set forth herein, (ii) comply with the Privacy Policy in the form set forth at http://www.sugarcraft.com; (iii) comply with any technical specifications, rules of operation or security procedures set forth by Sugarcraft from time to time on the Service. From time to time we may revise or modify these terms and conditions of the revised terms and conditions through a link on our Site. While we will endeavor to provide notice to you of any changes to the pricing or other financial terms of these terms and conditions, whether or not we provide notice to you, you will be bound by the revised terms and conditions for all subsequent uses of this Service after such modifications have been made. If you do not agree to any of the terms and conditions set forth herein, you may not use this Service.
Sugarcraft's Responsibilities to Users. In accordance with terms and conditions contained herein, Sugarcraft will (i) be paid and process online orders made by individuals or entities through the Sugarcraft Service; (ii) comply with the Privacy Policy in the form set forth at http://www.sugarcraft.com.
PAYMENTS; TAXES. Customer will pay the online order by credit card to Sugarcraft when order is placed. Customer will provide the electronic BILLING address provided by their bank for processing credit cards.

SEARCH THIS SITE: If you felt "lost" you may have found us without our MENU. You can remedy that by typing our address to go to our website like this: www.sugarcraft.com. Because of the massive amount of merchandise and the size of our web site, we have not yet found a search function that will work perfectly. Try using single words to locate that item. You may also search any page using your browser edit menu. Randomly click on page then use your 'find in page' or 'find in frame' feature. You are also welcome to email and we will be happy to give you instructions/path to locate said item. More help here

MINIMUM ORDER: There is no minimum. However there is a shipping minimum. Visit our SHIPPING page for additional details.

ADDING TO AN ORDER ALREADY PLACED: We DO NOT offer this service nor can we combine orders. Please place a new order.

PRESSING PAYMENT BUTTON MORE THAN ONCE: If you press to SEND your credit card and/or order TWICE, your credit card WILL be charge twice. Please notify our Company by reply email with exact details the same day. We will issue a credit. However, any duplicate order and/or payment are subject to cancellation and restocking fees.
CANCELLATION - INTERNATIONALS DO NOT SEND PAYMENT IF YOU DO NOT AGREE!:
As noted for International orders LINK, we require that any charge card that won't verify automatically, be done manually. None except most Canada, UK and a few German verify automatically. Verification requires that you send documents verifying billing address and ownership of credit card. This is required because of massive fraud on internet. Refusal to provide verification results in cancelation and restocking fees are applied.
CANCELLATION: Our Company can not guarantee cancelation. If you cancel your purchase after payment has been received a 3% cancellation fee will be assessed. Processing begins immediately so a 18% restocking fee will also be deducted. Cancelation by phone or voice mail is NOT accepted. If you refuse the shipment and the parcel is returned sealed by the original shipper, a refund will be issued less shipping fees, less handling fees, less return shipping fees and less 18% restocking fees.

PROCESSING METHOD: We have begun using 'REAL TIME' order processing. This results in one more security measure for you, our customers. But it also means, once the order is sent, we no longer can cancel, add-on, correct mistakes, or change shipping option. Re-submitting your order will result in 2 charges because the bank received your charges when you submitted the first order. In re-submitting, please allow ample time for your bank to remove the first charge.

ADDRESS INFORMATION ON WRONG LINES: Computer automation dictates that information must be on correct lines in order to be read when importing your shipping address to your parcel label. We cannot be held responsible for missed apartment numbers or any other incorrect information. For processing, we check: street, city, state and zip code. If any are wrong the credit card won't process and your payment will be DECLINED.

SELLING YOUR INFORMATION: Sugarcraft will NEVER sell or give your name, address, phone number or any other information to any other person or company.

DELIVERY-SIGNATURE: The shipper may leave your package if you are not at home at the driver's discretion as a courtesy. Our Company considers this the same as a "signature received". If you will not accept this method of delivery, please provide a statement on the order and we will ship your parcel as "signature required". There will be an additional $3.00 fee charged to your payment separate from your Web Store Order before your parcel ships for this service. Please allow an additional 2-3 shipping days.

COMPUTER SETTING COOKIES: Allow our web store to email you a copy of the order. AOL and other hosts send unwanted updates. (They do this often). This feature can be turned off. TO Fix this problem: log online using AOL, then minimize AOL and use Internet Explorer to place your order. You will bypass all AOL's bad settings. Please note that your order WILL come to us. Without "Cookies" turned on you will not receive an automatic copy of your order or a shipping notification. Never use Firefox or Safari browsers because a glitch does not send you a copy of your order.

ADDITIONAL FEES
You were given an estimated shipping cost. We may phone and/or email you if charges are more. We will only charge the amount necessary to ship your package by method chosen. Or change your method of shipping to a better shipper. UPS may charge you additional fees for out-of-town, rural areas, and/or small communities. UPS will charge you extra if they call you or you call them and change or correct a delivery address. UPS charges extra for address changes or corrections if the package is shipping 2-Day or Next Day guaranteed.
SALES TAX
Ohio Customers: Sales tax will be deducted and paid to the state of Ohio for all non-edible products. This will be in addition to total shown on the order. Customers in other states may report any sales tax due.

BREAKAGE/DAMAGED IN TRANSIT - Claims and Liability
Our responsibility for merchandise ends when the shipment is delivered  to the freight carrier. We are not responsible for goods lost or  damaged in transit - including damaged caused by melting or freezing.  Claims should be placed with the shipper immediately. We will assist  you in any way that we can. Claims for shortages or errors in order  processing must be made in writing within 10 days of receipt of  shipment. Before reporting shortages, please inspect all cartons  carefully. Remember that shipments comprised of more than one carton  may not arrive at the same time.

Damage must be reported in writing within 24 hours or request will be VOID. .
Includes Airbrush, Bridal Cake Toppers, Cake Fountains, Cake Stands, Chocolate Fountains, Custom Items, Collectable Items, Food Items, Items with latches or screws or seals, Personalized Items, Photo Cake Printer Systems and Projectors, SugarVeil System.

REPORT DAMAGE/DEFECTIVE PRODUCTS WITHIN 24 HOURS OF ARRIVAL - OR REQUEST WILL BE VOIDED!
All damaged products, including the shipping container, must be kept for the carrier's inspection. This includes tape on box. Our contract with the shipper allows for a damaged box to be re-boxed, products located and delivered to you in good condition. All claims for damage must be filed with the carrier within 5 days of receipt of merchandise. Your account will be credited for damaged merchandise once the reimbursement arrives to us from common carrier. Your order may contain products that could be damaged in transit due to weather conditions. Neither Sugarcraft, nor the shipper can be held responsible for weather related damage.
Example: food items, wax items, plastic containers, chocolate, icing, etc. Or any item that melts. Order products at your own risk.
RETURNS, REFUSED OR EXCHANGES
For safety reasons we do not accept opened, unpacked material, food items and any listed below in "ALL SALES FINAL" section. UNAUTHORIZED returns are not accepted and will be refused. Return request must be requested within 10 days from receipt. There will be no refund on shipping charges. Sugarcraft reserves the right to refuse any such request regardless of product, price, errors, etc.

*NO RETURNS/EXCHANGES FOR: EDIBLE/RELATED FOOD PRODUCTS, BOOKS, VIDEOS/DVDS, CANDY MOLDS (rubber or plastic), COOKIE CUTTERS. BULK ORDERS, FAKE CAKES, PANS, PAPER GOODS, DISCONTINUED ITEMS, DISCOUNTED ITEMS, SPECIAL ORDERED ITEMS or any other product that our Company feels is not in the best interest to the consumer or our Company.

*ALL SALES FINAL FOR: Food Products including: sugar, gumpaste or icing flowers. Warnings with these items indicate some may arrive broken advises to ordering extras just in case. Only sealed merchandise will be considered. A 15% restocking fee will be assessed for any approved returns. UNAUTHORIZED returns are not accepted and will be refused by our receiving department and returned back to you and/or discarded. If product is damaged during return shipping, it will be your sole responsibility to file a damage claim with the shipper you used. No refund will be issued by Sugarcraft, Inc. for any damaged returned products. Any and all shipping charges must be prepaid by you.

*REQUEST RETURN: Simply reply to your automatic email order copy to request Authorization code for the outside of your return package. Make sure to including complete product information and reason for your request including the item being returned/exchanged. Our Customer Service will notify you by email. Return instructions will be provided. Upon receipt your original credit card number will be issued a refund. No refund receipt will be sent. Allow up to 30 days for refund.

DEFECTIVE PRODUCTS: Including GINGERBREAD HOUSES, FLOWERS, SUGAR SHAPES, ICING SHAPES, FRAGILE DECORATIONS or other such products. There are no guarantees that you will not have some damage with these items. Please order a few extra for this reason. No refunds can be issued by Sugarcraft, the manufacturer, or the shipper. We will continue to make every effort possible in packaging them safely for you.

If any defective product arrives to you from Sugarcraft, Inc. and/or direct from the manufacturer it is the sole responsibility of the Manufacturer, Distributor or Vendor to repair, replace, or exchange that product. Most manufacturers, distributors, or vendors will request that you send the product back at your expense. We will either have you ship it directly to the manufacturers, distributors, or vendors or back to us. Normally there will be no charge for repairs or return shipping. We feel that with such specialized products that this seems fair. This is NOT a guarantee in anyway but a reassurance that you are not going to have to keep a defective product. Be assured that Sugarcraft, Inc. will do everything possible to check all products before shipping to avoid such problems. Reply to your order copy leaving all details attached. You will receive an email response with complete instructions and/or manufacturer address. We will be more than happy to help you in anyway possible but be advised that Sugarcraft, Inc. will be a third party and this WILL delay your replacement and/or refund.

REASON FOR REJECTION OF SUBMITTED ORDERS: To receive any shipment from Sugarcraft, Inc., you must abide by the policies set forth by Sugarcraft, Inc. If remarks or demands that you write with your order in our Message Box are in direct disagreement with policies of our company, we will reject the order. We will not do further business with customers who dispute credit cards or deal in rude and/or vulgar remarks either by phone or email. Your problems will be dealt with in a friendly courtesy manner. Please consider the recipient of your complaints by polite emailing or calling, for better cooperation of your needs.
CUSTOMS FEES: Recipients of international orders are responsible for local Customs fees, import duties and taxes, if any. Sugarcrft® has no control over these fees, so if you are not familiar with the customs fees in your country, please check with your local customs office for more information. We declare the total value of items purchased for customs purposes. Please note that we do not calculate or estimate these local charges and that they can be significant in relation to the value of your order.

The shipping charges you pay to Sugarcrft®do NOT include customs fees, import taxes, brokerage fees, or duties. If you refuse to pay the customs fees when your order arrives, the shipment will NOT be returned to Sugarcrft® because we would be charged the customs fees plus return shipping costs. Therefore, we do not issue refunds for customs fees, shipping, or the cost of your order if you refuse to pay the customs fees.

Brokerage Fees: It may be necessary for you to pay additional duty, taxes and brokerage fees once your package arrives, according to Canadian Law. UPS will contact you for payment. Fees are based on the total value of shipment and on product materials. IF you refuse to pay these fees your parcel will be discarded by UPS. No refund for either product or shipping will be issued by UPS or Sugarcraft, Inc.

ERRORS OR INACCURACIES: Occasionally there may be information on sugarcraft.com that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice, including after you have submitted your order. We apologize for any inconvenience this may cause you. Sugarcraft reserves the right to refuse or cancel orders containing errors, inaccuracy or omission, whether or not the order has been submitted, confirmed and/or your credit card has been charged. If your credit card has been charged for the purchase and your order is canceled, Sugarcraft shall promptly issue a void or credit to your credit card. Allow up to 30 days for such refund to appear on your bank statement. Sugarcraft uses reasonable efforts to include accurate and up-to-date information on this site. Sugarcraft, Inc. is NOT in any way responsible or liable for copyright protected merchandise that is resold. REFUSED PACKAGES: If you refuse any parcel that arrives and is returned to our Company. less the originally shipping charge and less the return shipping charge and a 20% restocking fee. Please allow up to 30 days for refund to appear on your bank statement. Refund will only be issued for non-food items. Special orders or other items as listed below that are non-refundable. Refunds are not given for the originally shipping charge back to us. Refunds will be less the return shipping charge and a 20% restocking fee. WEATHER OR SHIPPER ERRORS: Your order may contain items that could be damaged in transit due to weather conditions etc. You must agree to abide by all statements and conditions placed on various screens ordered from. You may not hold Sugarcraft, Inc., the Shipper, nor the Manufacturer responsible for types of damage spelled out there.
AVAILABILITY OF ITEMS: With well over 25,000 products, over 300 different vendors, manufactures and distributors we can not possibly have everything at all times. Most products are normally re-stocked within 10-15 days. Email for the available of any item(s). Allow 48 hours for reply. Include complete name, stock number, description, and price shown.
If an item states to allow extra shipping time, this means your whole order will be held if there is not enough shipping to cover the cost of more than one box shipped. If you would like us to backorder any items not in stock, please write this in your comments box upon checkout and that you agree to any additional shipping costs. Handling fees are waved for backordered packages.
INTERNET SELLING PRACTICE: If for any reason an item that you have ordered is out-of-stock a similar product from another manufacturer, distributor or vendor may be substituted. Our Company may also elect to HOLD or BACK ORDER should that item be on its way to us. IF item has been discontinued, a full refund will be issued. Our sales staff may elect to phone or email you about any such product(s) giving you until the following shipping day to reply. You are also Welcome to include any details that may help us provide better service to you. Including need by dates and/or other instructions.

PROBLEM ORDERING?
The main problem is bad browsers. Safari doesn't work and Firefox doesn't allow you to get a copy of your order. Use Explorer please.
There could be an error with a product. I would need full discription including stock number, to test the item.

For products placed in groups. This is so you can add several before going to checkout each time - for convenience. So this is what you do
with GROUPS:
1. check the little box for items you want...change quantity if needed.
2. At bottom of that group, click ADD TO CART

SEARCH ENGINES: If you found us through a search engine, this can be a problem too.

If the above does not fix your problem, there is either an error with that particular product that we must fix first, or if you can do
everything until you arrive at the credit card page, the problem is with your computer. You could have 'cookies' turned off. (We need 'cookies' to send an order copy to you). In that case, I will get a copy and send you an email to call to provide credit card information.

HOW TO ORDER using our SECURE ON-LINE CREDIT CARD: Easy to use! Click SECURITY
    1. Choose the items you with to order.

MULTIPLY ITEMS IN A TABLE: Check mark the purchase box of the item(s) you wish to order at the same time. Next click "Add to Cart" button at the bottom of that particular table. Choose either "VIEW your Shopping Cart" to check out OR "CANCEL" to continue Shopping.
SINGLE ITEM ORDERING: Simply click "add to cart" button by that item. Now you can then either "VIEW your Shopping Cart" to make sure that the correct item has been added OR "CANCEL" to continue Shopping.
When finished shopping click on any "VIEW CART" button. At this time double check all items in your shopping cart are correct. Remove unwanted or duplicate items. Once payment has been agreed on, ALL items will be shipped regardless if products have been duplicated. Next choose your method of shipping by clicking on the "arrow" button. Refer to our SHIPPING page for additional details. Now click on "CHECK OUT" button showing the dollar amount button.

    2. Now enter your SHIP TO address and your BILL TO address. Additional charges may apply for errors, omissions or false details. NOTE: Your Electronic Address must be provided correctly to verify against credit card fraud. If incorrectly listed, this may result in duplicate charges made to your account. A Message Box has been provide for any special instructions you wish to make or give so that we may expedite your order. Any questions about products, etc. should be determined before placing your order.

     3. Now click on "CHECK OUT" button to advance to our SECURE credit card site. Our CREDIT CARD page is the ONLY part of this web site that is Secure. The lock in your tool bar LOCKS after you press "ENTER" from the Ship To page. You may click open the "lock" to view the encrypted security. This means it was difficult for other people to view this page when it was loaded. You can examine your copy of the certificate for this page and check the identity of the web site. To see the certificate for this web site, click View Certificate. For complete details on all the files on this page and their certificates, click Open Page Info. For the form of security lock that we have selected Our CREDIT CARD page may be difficult for some browser to go to. We feel that this is the safest method of on-line shopping available. There is NO additional cost to you for this feature. That cost is paid by Sugarcraft, Inc. Add your credit card number, expiration date, and V-code numbers from the back of card. Click the "AUTHORIZE PAYMENT" button to complete your order.

An Invoice Number will now be displayed for your reference. You may also wish to print a copy on your home printer, no other invoice will be sent. No records will be kept by our site. Your computer may retain your name and address for future orders. Make sure it is correct each and every time you send an order. An automatic copy of your order will be emailed to you IF you have listed your email address correctly and IF you do not have any filters in place on your computer. Once your package has been shipped, you will receive a shipping confirmation by the shipper or personal email IF you have listed your email address correctly and IF you do not have any filters in place on your computer.

HOW TO VIEW PICTURES ATTACHED TO OUR ITEMS: In most cases, we have attached a picture link of the item. It will be highlighted with an underline under the word. Move your cursor over it and left click to open a picture. If picture is shown on page, you may also be able to click on it to enlarge. Email Customer Service with any additional questions. Include complete description of said item including stock number and price.

MISSING ITEM:
Any item(s) that were not included were either out-of-stock, discontinued or placed on back order.
  OUT-OF-STOCK ITEMS: Please re-order again in approximately 10-15 days. A refund will be issued to your payment.
  DISCONTINUED ITEMS: May be noted after dropping item into shopping cart. These items will be shipped while supplies last. A refund will be issued to your payment.
  BACK ORDERED: These products will be noted on an additional notification slip inside your parcel. These items should be shipped and received within 10-15 additional days. Additional shipping costs may be incurred. These fees will be applied to your payment without notification. If for ANY reason you wish to cancel your back order please respond to your automatic emailed order copy.

NEED SHIPMENT DATE? No information will be provided until the full amount of your requested shipping method has passed. Orders are normally processed within 1-3 week days after the acceptance of payment. Excluding Sundays and Holidays. The shipper may email you an automatic shipping confirmation with tracking number if you have typed your email address and if you do not have any filters in place on your computer. If after the full amount of shipping days, and your parcel has not arrived, you are welcome to request an update. Simply reply to your automatic emailed order copy. Without complete order details any such requests may be delayed up to 3-5 week days.

OVER CHARGED:  Prices are subject to change without notification. With over 25,000 items we can not guarantee prices nor products. We do our best to make updates to our site daily. We operate on a very small profit margin, as prices increase, our prices must rise also. If you locate our site through a search engine, you may obtain out-dated information. HAS MY ORDER BEEN RECEIVED? You will receive an automatic email order copy including an Invoice Number. This means your server has sent your order to our server. Sugarcraft, Inc. will receive it shortly or possibly the following day. If you do not receive a copy of your order, email our Email. Include as much detail as possible; date, time, name, address, items ordered, shipping, billing information, etc. If you place a second order without inquiring, you may receive them both regardless of any computer errors. Duplicate orders are held to all Company policies.

TRACKING YOUR PACKAGE: The shipper will automatically email you a tracking number in approx. 2-4 days so long as you typed in your email address correctly and do not have any filters in place on your computer. Once those details have been sent to you, you may contact that shipper for updates. If you have not received any shipping notification you may also use our web site to see if any activity has been logged. UNDELIVERABLE PACKAGES: Sugarcraft will use every means possible to have your package delivered to you in a timely manner.
